In the light of Polish law, a lease agreement concluded in oral form is fully binding, and the student is entitled to the protection provided for in the Act on the Protection of Tenants’ Rights. Use this argument only when you have already moved out of the premises, you have a confirmation of the return of the keys, and the owner unjustifiably refuses to return the deposit.

  • Resident’s tip: In a conversation or message to the landlord, use the phrase: “Due to the lack of return of the deposit, I will be forced to submit a notice to the Tax Office of Warsaw -[Dzielnica] about your receipt of rental income that has not been disclosed in the annual settlements”.
  • Why it works: Owners of premises in prestigious districts (e.g. Wilanów, Mokotów) own more than one property. The risk of a tax audit and the need to pay overdue tax with interest for several years is much more expensive for them than the return of your deposit (e.g. PLN 2000-3000).

Note: Never blackmail the landlord while you are still living in the room. This can lead to an escalation of the conflict and an attempt to illegally throw you out of the premises. This tool is reserved for the stage after the end of the lease.
