Anatomy of a scam: How do scammers work in Warsaw?

Before you start browsing offers on Facebook groups or advertising portals, you need to know the mechanisms used by money extortionists. In Warsaw, three types of fraud are most common:

Fraud “on the owner from abroad”

The scammer puts up an ad for a very nice room in a great location (e.g. at Nowy Świat Street, near the Main Campus of the University of Warsaw or at Koszykowa Street near the University of Technology) at a price well below the market average.

The basis for the security of a remote transaction is to check whether the person you are talking to has the right to dispose of a given premises. You can do this remotely using public records.

Step 1: Request a Land and Mortgage Register (KW) number

Each property in Poland has its own unique land and mortgage register number. The owner, who has nothing to hide, will give you this number without any problem.

  • Enter the address of the building where you plan to rent a room.
  • Analyze the report history for the last 6-12 months for that specific address and immediate neighborhood.
  • Frequent reports of disturbances of public order or noisy gastronomy on the ground floor of the building are a clear warning signal that you will not see in nice photos from the advertisement.
  • Reports of rodent infestations (rats, mice) in a given tenement house or block of flats in Praga or Śródmieście will allow you to avoid serious hygiene problems.

Frequently asked questions about distance rental

What to do if, upon arrival in Warsaw, it turns out that the room is drastically different from the one in the video-presentation?

You have at your disposal the institution of warranty for physical defects of the rented item (Article 664 of the Civil Code). If defects prevent the use of the premises provided for in the contract (e.g. lack of heating, non-working connections, fungus on the wall, lack of key furniture declared on the video), you can demand an immediate reduction in the rent or terminate the contract without notice periods. The condition is to immediately prepare photographic documentation and send a written request to remove the defects.

Can a real estate agent in Warsaw demand a fee before showing me the room or signing the contract?

No. Legally operating real estate agencies charge a commission (usually 50% or 100% of one month’s rent) only after the transaction has been successfully completed, i.e. at the time of signing the lease agreement between you and the owner of the premises. Demanding any reservation fees, registration fees or for “preparing an offer” before signing the actual contract is almost certain proof of an attempt at fraud.

How do I safely send a deposit if I don’t have a Polish bank account yet?

If you’re moving from abroad, avoid sending deposits through fast cash transfer systems (e.g. Western Union). The safest option is to transfer SEPA (in the Eurozone) directly to the owner’s bank account indicated in the lease agreement. You can also use licensed multi-currency systems (e.g. Revolut, Wise) – provided that the transfer is directed to the owner’s personal account, and in the title of the transfer you clearly write: “Security deposit – rent room no. Is a lease agreement signed with a scan (printout -> signature -> scan -> sent by e-mail) fully valid?

Such a form (documentary form) is valid unless the parties have stipulated in the contract the requirement of a written form under pain of nullity. However, from the point of view of evidentiary security, it is much better to use a qualified electronic signature or sign a document with a trusted profile on the government’s gov.pl platform. This makes it difficult for the owner to renounce the authorship of the agreement in the event of a legal dispute.

How to check if the apartment is not located in a nuisance neighborhood (e.g. next to the metro construction)?

Before signing a remote contract, check the exact address on the maps of planned urban investments in Warsaw. Pay special attention to:

  • Construction routes of the new M3 metro line (Praga-Południe).
  • Large tram investments (e.g. expansion of routes in Wilanów or Ochota).
  • Proximity to railway tracks (SKM/KM lines, especially in the vicinity of Warszawa Główna, Warszawa Zachodnia stations or the diameter line).
